Our website may provide a Search by Image feature that allows users to take a photograph or upload an image from their device, including from a computer, mobile phone, tablet, photo library or file storage, for the purpose of identifying or finding products available through our website.

By using the Search by Image feature, you agree that you will only upload images that you are legally permitted to upload and that are appropriate for use with our service.

1. Prohibited Images

You must not upload, submit, transmit or otherwise provide any image that:

• Contains nudity, sexually explicit material or sexual activity.
• Contains intimate images of any person, whether real, edited, digitally altered or AI-generated.
• Contains or appears to contain child sexual abuse material or sexualised images of anyone under 18 years of age.
• Depicts sexual exploitation, abuse or non-consensual sexual content.
• Depicts extreme or unlawful violence, torture, serious injury or graphic content.
• Promotes, depicts or facilitates terrorism or other serious unlawful activity.
• Contains content that is unlawful, threatening, harassing, abusive, defamatory or otherwise inappropriate.
• Contains personal, private or confidential information belonging to another person without appropriate permission.
• Infringes another person's copyright, trademark, privacy, publicity or other legal rights.
• Contains malicious code or is designed to interfere with, damage or compromise our website, systems or services.
• Is submitted for the purpose of abusing, testing, circumventing or attempting to manipulate our Search by Image technology.
• Otherwise violates applicable Australian laws or the laws applicable to you.

2. Your Responsibility

You are solely responsible for the images you upload through the Search by Image feature and for ensuring that you have the necessary rights, permissions and lawful authority to submit them.

You should not upload photographs of other people, particularly photographs containing sensitive or private information, unless you have an appropriate legal basis or permission to do so.

Uploading an image to our Search by Image feature does not give you permission to use another person's image, likeness, personal information or copyrighted material.

3. Moderation and Removal

We reserve the right, at our discretion and without prior notice, to reject, block, restrict, remove or otherwise prevent the processing of any image that we reasonably believe may breach these Terms of Service, our policies, applicable law or the safety of our users or services.

We may also suspend or restrict access to the Search by Image feature or other parts of our website where we reasonably believe that a user has misused the feature or breached these Terms.

4. Illegal or Serious Harmful Content

If we become aware of, or reasonably suspect, that an uploaded image involves serious unlawful activity, child sexual abuse material, terrorism-related material, exploitation, threats to a person's safety, image-based abuse or other content that may require reporting, we may take appropriate action.

This may include removing or preventing access to the content, preserving relevant information where legally permitted or required, restricting or terminating the user's access, and reporting or disclosing information to law enforcement, regulators or other appropriate authorities where we are legally required or permitted to do so.

We may cooperate with Australian federal, state or territory law enforcement agencies, the eSafety Commissioner and other competent authorities where appropriate.

Nothing in these Terms prevents us from making a report or disclosure where required or authorised by law.

5. Privacy and Image Processing

Images submitted through Search by Image may be processed by us and/or third-party technology providers for the purpose of providing the Search by Image functionality, including analysing the image to identify or match products.

We will handle personal information in accordance with our Privacy Policy and applicable privacy laws.

Users should avoid uploading images containing unnecessary personal, sensitive or confidential information.

Where an uploaded image contains personal information, our handling of that information may be subject to applicable Australian privacy laws and our Privacy Policy.

6. No Guarantee of Results

Search by Image is provided as a convenience and may not accurately identify products, people, objects, brands or other content shown in an uploaded image.

We do not guarantee that every image will be recognised or that search results will be accurate, complete or suitable for your intended purpose.

7. Acceptance of These Conditions

By uploading or taking an image using the Search by Image feature, you acknowledge that you have read and agree to these Search by Image conditions and agree to use the feature only for lawful and appropriate purposes.

8. Changes to the Policy

east retails reserves the right to modify, update, replace or change this Search by Image Policy at any time and at our discretion. Changes may be made without prior notice or individual notification.

Any changes will become effective when the updated policy is published on our website. You are responsible for reviewing the current version of this policy before using the Search by Image feature.

Your continued use of the Search by Image feature after any changes are published constitutes your acceptance of the updated policy.
